State/Territory Usage Notice

This notice summarises key road rules and legal restrictions for private electric scooters (e-scooters) and electric bikes (e-bikes) across all Australian states and territories. All riders are responsible for understanding and complying with local transport legislation in their jurisdiction. Scooter Bike Hub accepts no liability for fines, legal penalties, accidents, injury or property damage arising from illegal or non-compliant riding.
All standard e-bikes sold by us comply with national bicycle standards: maximum 250W continuous motor output, motor cut-off at 25km/h, and pedal-assist primary operation. Non-compliant high-powered electric scooters may be illegal for public use in many regions.

General National Mandatory Rules (All States & Territories)

  1. Minimum riding age: 16 years old for unsupervised operation of private e-scooters; children under 12 cannot ride PMDs on public land.
  2. Approved bicycle helmets are mandatory for all riders on public paths and roads.
  3. Front white light, rear red light and reflectors required for riding at dusk, night or low visibility.
  4. Zero passenger carriage: no carrying adults, children or pets on e-scooters.
  5. Blood Alcohol Concentration (BAC) limit of 0.05 when operating powered mobility devices on public land.
  6. Riding under the influence of drugs or alcohol carries heavy fines.
  7. Commercial rental PMD rules do not apply to privately purchased devices from our store.

State-by-State Private E-Scooter Key Restrictions

New South Wales (NSW)

  • Private e-scooters are only legal on private property. Riding on footpaths, shared paths, bike lanes or public roads is prohibited and attracts significant fines.
  • Only council-approved rental e-scooters are permitted in designated trial zones.
  • Standard pedal e-bikes follow regular bicycle laws and may be ridden on bike paths and roads.

Victoria (VIC)

  • Permitted on roads ≤60km/h speed limit, separated bike lanes and shared cycling paths.
  • Footpath riding is banned for private e-scooters.
  • Maximum device top speed limited to 25km/h; riding speed capped at 20km/h.
  • Power limit 500W for legal private PMDs.

Queensland (QLD)

  • Most permissive state: allowed on footpaths, shared paths, bike lanes and local roads ≤50km/h.
  • Footpath speed limit: 12km/h; road/bike path speed limit: 25km/h.
  • Minimum 12 years old with adult supervision; 16+ unsupervised.

South Australia (SA)

  • Allowed on footpaths, shared paths, bike lanes and roads with speed limits ≤50km/h.
  • Footpath maximum speed 10km/h; bike path/road maximum 25km/h.
  • Cannot ride on roads with speed limits above 50km/h.

Western Australia (WA)

  • Private e-scooters restricted to private property only in most regions.

Tasmania (TAS)

  • Private e-scooters may only be used on private land. Public footpath and road riding is prohibited without official council approval. Standard pedal assist e-bikes are permitted on bike infrastructure.

Australian Capital Territory (ACT)

  • Permitted on footpaths, shared paths, bike lanes and local roads up to 50km/h.
  • Footpath speed limit 15km/h; maximum 25km/h on bike paths and roads.
  • Must yield to all pedestrians on footpaths.

Northern Territory (NT)

  • Allowed on footpaths, bike lanes and local roads with speed limits under 50km/h.
  • Footpath speed limit capped at 10km/h, road speed limited to 25km/h.
